Question

I have one follow up question regards the applicability of these templates, following up on Q&A #2531. Could EIOPA please confirm the case where all of an insurer's business outside the home country is in run-off (but liabilities still remain) i.e. there are no premiums written or earned during the financial year from business outside home country but there has been claims and/or expenses incurred. In this scenario: 1. We understand S.04.03 and S.04.04 must still be reported but we are not sure if S.04.05 should be? 2. Would there be any difference to the answer to question 1 regards S.04.05 above regarding the nature of the business outside home country eg if the business was written in home country but risk was outside the home country would that be different requirement to business written outside home country etc. Basically the definition of "Activity" is what we question (we don't think it's strictly defined anywhere).

EIOPA confirms that in the case described templates S.04.03, S.04.04 and S.04.05 are to be reported. On your second question please note that the instructions of the S.04.05 template includes a definition of the 'country in which the risk is situated' which is to be used for identification of the countries to be reported based on the specific situation.
