Question

Should medical underwriting be considered a strict requirement of the "individual risk assessment" in determining the contract boundary of a policy?

EIOPA answer

The individual risk assessment referred to in Article 18(3) of Commission Delegated Regulation (EU) 2015/35 should allow the undertaking to gather sufficient information in order to form an appropriate understanding of the risks associated with the insured person (See also Guideline 4 of EIOPA's Guidelines on contract boundaries).

The individual risk assessment might involve medical underwriting, but this is not required.
